Introduction

These Terms of Use ("Terms") govern your use of QATestLab Roll Call Chatbot ("Chatbot"). Chatbot is offered by QATESTLAB LIMITED, having its registered office at 34 Falirou Street, 1st floor, office 115, Strovolos, 2066, Nicosia, Cyprus, Registration number HE 412671, and its affiliate companies and subsidiaries (hereinafter - “QATESTLAB”, “we”).

“Service” means Chatbot functionality made available by QATESTLAB via Telegram platform (hereinafter - “Platform”) to you, solely for quickly determining your status for the current moment. Chatbot is used in case of emergency conditions: blackout, lack of mobile communication, etc.

1. Users

You may use our Services only if you are a current QATESTLAB employee or contractor.

When using Chatbot our Services you shall comply with these Terms, all applicable laws, and our policies Any violation of our Terms, applicable laws, or Policies may result in your access to all or part of the Services being suspended, disabled, or terminated.

You may interact with Chatbot, directly or indirectly via Platforms, using a valid email address, phone number, first name, and last name. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. You may not share your account login credentials with anyone else.

2. Access

Subject to these Terms, We grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use Chatbor and our Services. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access.

You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content; create false profiles on the Chatbot; practice reverse engineering, decompiling, disassembling, decrypting or otherwise attempting to obtain the source code concerning any associated intellectual property used to provide all or part of the Services; use manual or automatic devices or software, coding robots or other means to access, explore, extract, or index any page of the Chatbot; simulate the appearance or functioning of the Chatbot; distribute anything containing a computer virus or any code, file or software program intended to interrupt, destroy or limit the functionality of the Chatbot or its infrastructure.

You must uninstall or stop using and accessing the Chatbot when You are no longer authorized by QATESTLAB to access the Chatbot.

We reserve the right to revoke any license to access the Chatbot and use any content at any time, with or without notice, if we decide or are obligated to disable access to the Chatbot for any or no reason, including for any violation of these Terms, for unexpected technical issues or problems, if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. You agree that we will have no liability to you or any third party for the termination of your account, removal of your content, or blocking your access to our services.

3. QATESTLAB`s rights

All rights, titles, and interest in and to Chatbot and Our Services submitted or provided through our Services, functionality, user experience, look and feel of the Chatbot, color combinations, etc. are and will remain the exclusive property of QATESTLAB. Our services are protected by copyright, trademark, and other laws.

Nothing gives you a right to use our name or any of our trademarks, logos, domain names, and other distinctive brand features.

4. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CHATBOT FUNCTIONALITY OR SERVICE ACCESSIBLE THROUGH THIS FUNCTIONALITY IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. QATESTLAB DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, OR THAT THE CHATBOT WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT THE CHATBOT WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. ACCESS TO CHATBOT AND/OR RELATED SERVICES MAY BE SUSPENDED OR WITHDRAWN TEMPORARILY OR PERMANENTLY, AT ANY TIME AND WITHOUT NOTICE, AT OUR SOLE DISCRETION. WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT CHATBOT/APPLICATIONS WILL BE COMPATIBLE WITH OR ACCESSIBLE USING ALL HARDWARE AND/OR SOFTWARE.

5. Indemnification

You agree to indemnify, defend, and hold harmless QATESTLAB from and against any third-party claims, demands, losses, damages, or expenses, including reasonable attorney fees related to (a) your use or attempted use of the Chatbot or Services in violation of these Terms; (b) your violation of any law or rights of any third party; (c) the content you post or submit. Your indemnification obligation will survive the termination of these Terms and your use of the Chatbot or Services.

6. Governing Law

You agree that these Terms will be governed by the laws of Cyprus, without giving effect to the provisions, policies or principles thereof respecting conflict or choice of law. In the event of any dispute related to these Terms that is not subject to binding arbitration, you and QATESTLAB will submit to courts located in Cyprus as the legal forum for any such dispute.

7. Miscellaneous

You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with QATESTLAB. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.

We may collect and process your personal data which is essential for the operation of the Chatbot functionality in a manner and under conditions specified by Privacy Notice.

We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
